The Welsh Ministers make these Regulations in exercise of the power conferred on them by section 146(1)(a) and (2) of the Tertiary Education and Research (Wales) Act 2022( 1).
In accordance with section 143(3) and (4)(e)(ii) of the Tertiary Education and Research (Wales) Act 2022, a draft of this instrument has been laid before, and approved by resolution of, Senedd Cymru( 2).
1.—(1) The title of these Regulations is the Tertiary Education and Research (Wales) Act 2022 (Consequential Amendments) Regulations 2025.
(2) These Regulations come into force on 5 April 2025.
2. In paragraph 22 (School Standards and Organisation (Wales) Act 2013) of Schedule 1 (minor and consequential amendments and repeals) to the Additional Learning Needs and Education Tribunal (Wales) Act 2018( 3), omit subparagraph (4).
3. In regulation 4(1)(d) (exceptions) of the Playing Fields (Community Involvement in Disposal Decisions) (Wales) Regulations 2015( 4)—
(a) for “Welsh Ministers” substitute “Commission for Tertiary Education and Research”;
(b) for “section 72(1)” substitute “section 63D(2)”.

The Tertiary Education and Research (Wales) Act 2022 (“ the 2022 Act”) abolishes the Higher Education Funding Council for Wales and creates the Commission for Tertiary Education and Research (“ the Commission”).
Paragraph 29 of Schedule 4 to the 2022 Act amends the School Standards and Organisation (Wales) Act 2013 (“ the 2013 Act”) in relation to school reorganisations. Those amendments include removing the Welsh Ministers’ powers to make proposals to restructure local authority maintained school sixth form education, instead giving the Commission powers to restructure sixth form education.
These Regulations make consequential amendments to primary and secondary legislation to reflect those amendments made to the 2013 Act by the 2022 Act.
The Welsh Ministers’ Code of Practice on the carrying out of Regulatory Impact Assessments was considered in relation to these Regulations. As a result, it was not considered necessary to carry out a regulatory impact assessment as to the likely costs and benefits of complying with this instrument.
