UPON the Consent Order dated 28 May 2018 staying the proceedings (the “Consent Order”)

AND UPON reviewing the Claimant’s Application No. CFI-031-2017/5 dated 2 August 2024 seeking an order to revoke the Consent Order and to lift the stay of the proceedings (the “Claimant’s Application”)

AND UPON reviewing the Defendant’s Application No. CFI-031-2017/6 dated 20 August 2024 seeking an extension of time until 27 August 2024 to file and serve evidence in answer to the Claimant's Application (the “EOT Application”)

AND UPON reading the Claimant’s evidence in answer to the EOT Application dated 21 August 2024

AND UPON reading the Defendant’s evidence in reply dated 21 August 2024 filed in support of the EOT Application

IT IS HEREBY ORDERED THAT:

1. The EOT Application is granted.

2. The Defendant shall be granted an extension of time until4pm on Tuesday, 27 August 2024to file and serve its evidence in answer to the Claimant’s Application.

3. Costs shall be costs in the case.
